Auch die NSA interessiert sich für das Kartellrecht

Neulich traf ich bei der Arbeitssitzung der Studienvereinigung Kartellrecht zufällig Edward Snowden. Wir kamen in der Kaffeepause ins Gespräch und wie ich beiläufig erwähnte, dass ich bei Beck zum Kartellrecht blogge, drückte er mir ein paar Blatt Papier mit Computerausdrucken in die Hand. Zu meiner nicht geringen Überraschung handelte es sich um Auszüge aus Abhörprotokollen der NSA. Das heißt, ich muss mich genauer fassen. Dass es sich um Abhörprotokolle handelte, wunderte mich nicht. Was für Zettel soll Edward Snowden sonst verteilen? Überraschend war, dass es sich um Gespräche des Wettbewerbskommissar Almunia handelte, die dort dokumentiert waren. Inzwischen ist ja allgemein bekannt, dass die NSA noch nicht einmal vor der GD Wettbewerb bzw. vor deren Telefonapparaten Halt machte (vgl. zur Pressemitteilung der Kommission vom 20.12.2013). Und so kann ich zu Weihnachten ein paar Auszüge aus den Abhörprotokollen präsentieren:

Caller [NSA ID – EU COMP #2]: I had a funny call just a second ago. A guy from Fort Meade of something, by the name of Keith, did not want to say his surname [NSA internal note: Must tell DIRNSA not to use his real name for calls]. Said we should take a closer look at the London-Philadelphia route in the US Airways/ American Airlines case.

Target: What case?

Caller [NSA ID – EU COMP #2]: A new case. We talked about it recently. The formal notification was received today, Bernd told me.

Target: And why did this man call you?

Caller [NSA ID – EU COMP #2]: I have no idea. Said he wanted to talk to me. Could not reach you or Barroso on your private mobile phones.

Target: He had my private mobile number?! And what did he say?

Caller [NSA ID – EU COMP #2]: Cousins of him living in London regularly come over to Washington for meetings with his lot and like to use the route. Could go directly to Washington or Baltimore, but it was less noticeable to fly into Philly. It was important. There would be no choice between competing airlines for them anymore. Whether he could rely on us to deal adequately with this. Said, it was a matter of national sec….[end of recording; NSA internal note: loss of signal due to GCHQ interference with the call].
