Deutschland erneut von EGMR verurteilt

Der Europäische Gerichtshof für Menschenrechte hat entschieden, dass das Fehlen eines Rechtsbehelfs zur Beschleunigung überlanger Verfahren in Umgangssachen gegen die Europäische Menschenrechtskonvention verstößt.

Der Beschwerdeführer ist Vater eines 2003 nichtehelich geborenen Sohnes, dessen Mutter dem Beschwerdeführer kurz nach der Geburt jeglichen Umgang mit dem Kind verweigerte. Seit Mai 2005 führte der Beschwerdeführer mehrere Verfahren vor den deutschen Gerichten, die sein Recht auf Umgang mit seinem Sohn betrafen. In seiner Beschwerde vor dem EGMR machte er geltend, die deutschen Gerichte hätten keine zügigen und wirksamen Maßnahmen ergriffen, um einen Umgang mit seinem Sohn zu ermöglichen, insbesondere um eine gerichtliche Umgangsregelung vom September 2010 durchzusetzen. Außerdem sehe das deutsche Prozessrecht keinen Rechtsbehelf vor, der geeignet sei, überlange Verfahren in Umgangssachen effektiv zu beschleunigen. Er berief sich u.a. auf Art. 8 (Recht auf Achtung des Privat- und Familienlebens) sowie auf Art. 13 (Recht auf wirksame Beschwerde) i.V.m. Art. 8 EMRK. 

Der EGMR hat einstimmig eine Verletzung von Art. 8 und eine Verletzung von Art. 13 i.V.m. Art. 8 EMRK festgestellt.

Wie geht es jetzt weiter für den Kläger?

Das EGMR Urteil hat keine kassatorische Wirkung. Deshalb hilft ihm das unmittelbar nicht weiter, wenn er Umgang mit seinem Sohn bekommen will. Einen Rechtsbehelf für die Verfahrensbeschleunigung wird durch das Urteil auch nicht geschaffen. Das Umgangsrecht wurde ihm ja zugesprochen. Wird dieses jetzt effektiv durchgesetzt?

(ii)  EUR 6,436.53 (six thousand four hundred and thirty-six euros and fifty-three cents), plus any tax that may be chargeable to the applicant, in respect of costs and expenses;

(b)  that from the expiry of the above-mentioned three months until settlement simple interest shall be payable on the above amount at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points;

Dass der Kläger (nur) eine Geldentschädigung vom EGMR zugesprochen bekommt, ist bekannt. Das zeigt ja gerade, dass das EGMR Urteil unmittelbar für den Umgang mit seinem Sohn nicht weiterhilft - eben die von mir angesprochene fehlende kassatorische Wirkung.

Die Frage ist, wie es in Deutschland weitergeht. Soweit der Kläger nicht mittlerweile schon sein Umgangsrecht effektiv ausüben kann, müsste er sich ja wieder an das deutsche Gericht wenden. Meine Frage lautet, wie er das macht oder zu machen hätte.
